Policemen Who Killed 2 OFWs Mistaken As MILF, Faces Imprisonment and Penalty

The Manila Regional Trial Court has given the convict to 9 policeman over the death of Esmael Omar. He was mistaken as rebel but it turns out that he was just an Overseas Filipino Worker.


In the ruling, the policemen were sentenced to 6-12 years of imprisonment.
Among the convicted were SPO4 Wilson Tirso Tibor, PO2 Philip Malindog, SPO4 Remigio Estacio, PO1 Ignacio Garlan, SPO3 Edgardo Abaga, PO3 Ronald Hernandez, SPO2 Julian Siriban, PO3 Randy Dimayuga, and SPO2 Eduardo Ramos.
It can be recalled that on June 8, 2000, these lawmen shot and eventually killed Omar as well as his colleague Samin Akmad in Quiapo, Manila. According to their confession, they thought that the two were members of the Moro Islamic Liberation Front (MILF).

The two men, who turned out to be OFWs set to leave for Jeddah, were killed over a bomb scare in Metro Manila.
According to the policemen, their operation was nothing but legal and they were just defending themselves when the incident took place.
However, the court ruled the incident as murder case and said that the lawmen were determined to kill the two Muslims.

“Even if this Court would consider that he (Omar) was in possession of a revolver as posed by the defense, the multiple gunshots he sustained which led to his death cannot, by any stretch of imagination, be deemed as an act of self-preservation on the part of the accused police officers,” the court says.
Furthermore, the murder case only points out to Tibor, who is said to be the shooter as stated by the witness.
“Further guided by the onus probandi (burden of proof) in criminal cases which requires moral certainty, this Court finds and so holds that acquitting the six accused of the first charge (Akmad’s death) would be in keeping with the ends of justice,” the court said.
The policemen are also set to pay the family of Esmael Omar for death indemnity worth P75,000, moral damages worth P75,000 and exemplary damages worth P30,000.
